The Department of Homeland Security (DHS) announced on Monday, November 11, 2019, via Federal Register notice that it is extending the validity of Temporary Protected Status (TPS)-related documentation for beneficiaries under the designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan through January 4, 2021.

For those with Employment Authorization Documents for those counties utilizing forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record, there will be an extension to their expiration dates.

El Salvador, Haiti, Nicaragua, and Sudan current expiration date of Jan. 2, 2020 may be extended to Jan. 4, 2021.

Honduras current expiration date of Jan. 5, 2020 may be extended to Jan. 4, 2021.

Nepal current expiration date of March 24, 2020 may be extended to Jan. 4, 2021.

Due to injunctions issued in the U.S. District Court for the Northern District of California and the U.S. District Court for the Eastern District of New York and a stay imposed in the U.S. District Court for the Northern District of California, these extensions were created to maintain compliance.

Final decisions in the U.S. District Court for the Northern District of California, could change these extensions for Nicaragua and Sudan. All affected TPS beneficiaries should be aware these are not confirmed extension dates and all pending litigation must be monitored closely for updates.
