Urgent DACA Update

On January 9th, an Order was entered by a U.S. District Court, directing the government to maintain the DACA program on a nationwide basis, in part. The Order requires the Department of Homeland Security to post “reasonable public notice that it will resume receiving DACA renewal applications” and to specify the process by which it will accept renewal. This Order only explicitly allows for DACA renewal filings, does not create any new opportunity to apply for Advance Parole and does dictate that discretion be exercised on each renewal application.

People with the most to gain are those whose current DACA expires after March 5, 2018, or those who previously held DACA and it expired.
